Ask and you shall receive. Kevin Kelley sent me the clause BYU has in it's Football contracts (the ones he has via FOIA, only public), should BYU join a conference:

Quote:B. Cancellation. The parties agree that if one party cancels, forfeits, unilaterally delays or postpones, or fails to appear at, any game (these and similar actions hereafter referred to as "cancel"), actual damages-including those relating to public relations, radio and television broadcasts, lost profits, and other consequential damages-would be difficult or impossible to calculate. The parties further agree that processes, including litigation, to determine damages would be both unnecessarily expensive and time-consuming. Therefore, the parties agree that if one party cancels (hereafter, the "defaulting party") any game or games, the defaulting party shall pay as liquidated damages to the other party One Million Dollars ($1 ,000,000) for each cancelled game, to be paid no later than thirty (30) days fol lowing the scheduled date for the game. Moreover, the defaulting party shall not be:: entitled to any guaranteed payment. However, if the defaulting party cancels because of(i) conditions entirely beyond the control of the defaulting party, such as war, government restriction, or an net of God, (ii) the defaulting party's decision to join a conference, whether currently existing or newly created, that is different from its current conference or independent affiliation, and that includes at least four (4) schools that currently belong to a Power 5 conference, which decision to cancel must be made and communicated to the other party within one year after the defaulting party joins that conference, but no later than eighteen ( 18) months prior to a cancelled game, or (iii) a mutual agreement in writing by the parties to cancel a game or the games, the defaulting party shall not owe or be entitled to any guaranteed payment under Section 3(A) or liquidated damages under this Section 3(8). The cancellation of any game shall not affect the remainder of this agreement, which shall remain in effect, including the obligation to play any remaining games specified in Section I of this agreement; provided, however, that cancellations for the reason listed above in clause (ii) must apply to both games (or, if one of the games has already been played, the parties agree to schedule the remaining game in another year on a mutually agreeable date).

Below are the future games that this applies to (public schools he has FOIA from)

Houston 2020, 2023
ECU 2022, 2024
Wisconsin 2017-18
Washington State 2021
Michigan State 2020
NMSU 2018
Arizona 2026-27
Missouri 2020
Utah State 2018-20

Four members of a power conference, basically means, if the B12 were to invite BYU, even in a mass exodus, should four schools remain, BYU can get out of these contracts. The MWC would NOT trigger the clause. Those are hefty buyouts.

There are many games against private schools where no FOIA can be obtained (Liberty, Stanford, USC, Baylor), and games with no such out clause (e.g., Boise State, whom BYU plans to play regardless), and no doubt some other games even lack that clause, as the planning is they would still be non-conference games. And others are older contracts lacking the wording. And some are unknown (never issued an FOIA).

The picture which emerges is that likely the majority of BYU games cannot be dropped without heavy financial penalty (no way would any MWC media package come close to those $1M buyouts, let alone match the revenue BYU gets from it's own TV deal). And given BYU's schedule is full through 2021 (I think just an FCS game and two games without a fixed date, but contractually locked are not set) it seems impossible for BYU football to be part of any move to the MWC, at least for the first 2 or 3 years of the new media contracts that would start in the 2019-20 school year, which in theory is when BYU would join.

This even makes an ACC like agreement to play say 4 MWC schools a year difficult to execute before 2022 season.

The clauses indicate BYU is intent on playing out the B12 scenario. IMO this makes a conference chance unlikely before Oklahoma's conference decision.
