This moron woman driver misses her exit on I-26 -- so she STOPS... in the fast lane at that.

My dad rear ends her (how couldn't you with traffic already in the other lane?).

We only have liability on his vehicle.... in the state of south carolina, REGARDLESS OF CONDITIONS OR CAUSES OR OTHER FACTORS, IF YOU REAR END SOMEBODY, IT'S YOUR FAULT.

Therefore, it is his fault for hitting some broad stopped on the interstate, and with only liability, we pay for all repairs to our vehicle.

GTS, hope both drivers are OK. Hope the other driver got a ticket for reckless. The whole situation sucks.

I believe that's the same law we have in Georgia...if you rear end somebody, it's your fault no matter what. That actually worked to my advantage last year when someone rear ended me when I was turning into a shopping center b/c my right blinker was burnt out. She smashed the right fender and light so there was no proof that it was. And basically the judge said something to the effect "well you shouldn't have been following that close anyway."

Sorry to hear about that GTS - hope he's okay.

But I think the blame should lie with the lawmakers, not the insurance companies, who are merely following an overly simplistic law.

That rule is basically in effect everywhere. I don't think it's so much any kind of "lobby" as it's a structure that tries to keep some kind of conformity in the system. As a general rule, when somebody is rear-ended, it is usually going to be the fault of the person who did the rear-ending. The thinking behind that is that -- even if the other person does something stupid -- you shouldn't be following them that closely (JJ alluded to this).

I realize there are cases where that doesn't seem fair -- this seems like it could be one of those. The good thing about it is that the insurance is there in the first place to pay for what happened.

Just be thankful that SC isn't a no-fault state. In that case, everyone would be going to their own insurance company regardless of who was at fault -- under any circumstances.

Yea - my dad was coming up a hill - and there the moron was stopped -- doing five under he still couldn't stop in time.

The ignorant ***** doesn't intend to show up in court - so looks like we get paid in the end anyway.

Please tell me how this is the insurance company's fault. First of all, it was your Dad's choice to only have liability coverage on the vehicle. Second, you should always keep a safe following distance in order to stop in case the vehicle in front of you stops dead in it's tracks. I repeat, what did the insurance company do wrong?

You still haven't answered my question. What has the insurance company done wrong? Your beef is with the state laws. Insurance companies operate under the laws in which they are told. Half-wits like you would blame the Kennedy assassination on insurance. :stupid:

I blame the insurance company because their lobby in the state of south carolina is very strong. What they want, they get -- and this is a law they passed with lobby help in our state.

You want to know why I am so defensive about this? It's because I work in insurance and it's people like you every week storming into my office, calling me everything but a child of God and threatening to cut off members of my anatomy because they are too damn ignorant and lazy to take the time to learn about insurance and laws. If they would do that, then they would understand why things are the way they are, and half my day wouldn't be tied up on the phone explaining things that clearly defined in their policies. :bang:

My hatred of the way insurance companies treat their customers started with my sister. Her truck was lost in a fire that started due to electrical problems in her truck. The insurance company claimed she was guilty of arson -- she burned it for the money. She had TurtleWax in her truck (not even near where the fire started mind you) - and they claimed it was a "class 2 isoparafin" -- that's in the same league with jet fuel folks -- she used as accelerant. The P.I. the insurance company hired put footage of his cats having sex in on the same tape as his "video findings."

Needless to say after being several dozen thousand dollars in the hole from legal fees etc, said insurance company dropped the charges, and they were taken to the cleaners on a countersuit for a multitude of things. Naturally we all enjoy higher premiums now -- anybody here not cynical enough to believe that's not a small measure of revenge?

I'm sorry about what happened to your sister, GTS, but it has a lot to do with the great number of people out there who abuse the insurance system to get money. Your insurance rates go up because dishonest people claim losses on things they either 1) did not lose, or 2) destroyed themselves. Of course, the rates also go up because of honest claims (like those pac10 has mentioned in his thread).

Yes, insurance companies want to make money. All of them do -- the good and the bad. They wouldn't be in business otherwise. But, most of them out there aren't looking to screw people over... they're looking to pay honest claims and make money off the rest of the premium that's left. To accomplish all that, they need to make sure they aren't paying fraudulent claims. Unfortunately, your sister got caught up in that... and for that, I'm sorry.

Swagger,

Since you hate insurance so much, I have the perfect solution for you. When you get your driver's license, place a bond in the amount of $50,000 with the state you live in. This will keep you from having to buy auto insurance. When you buy your first house, go ahead and pay it off in cash at closing. This way you won't have a mortgage company requiring you to have homeowners insurance. Then, when you have a family of your own, don't buy life insurance. Just make sure that they would be financially secure in the event of your death. Also, don't get any health insurance either. Just pray that you and your family stay healthy. This would complete your boycott against evil insurance companies.
