Grand Jury Clears Texas Tech Recruit Of Charges For Pick-Up Hoops Punch [Update]

Nigel Bethel II was dismissed from the Texas Tech football team on June 29, a day after a scuffle with women's hoops leading scorer Amber Battle in a rec-center basketball game. Now he's been cleared of charges, and after viewing surveillance video that shows Battle punching Bethel first, the grand jury took the unusual step of recommending that Bethel be reinstated.

Update, 8:02 p.m. EDT: Bethel has been reinstated by Texas Tech, and will serve a three-game suspension.

The initial release from TTU was terse, only confirming reports that Bethel had punched Battle, and broke a bone in her jaw. The surveillance video shows the two tangling over a rebound, then Battle taking a swing at Bethel before he retaliates with a punch of his own.

Yesterday, a Lubbock County grand jury found no evidence to bring assault charges against Bethel, and all 12 members signed a letter to Texas Tech AD Kirby Hocutt that read, in part,

"We believe he was unduly and prematurely punished. This was an unfortunate incident in a pick-up basketball game. This is a matter that should not result in criminal charges for either party.

"Any assault does deserve immediate action, however, please ensure all testimonies, evidence and circumstances are reviewed prior to taking action which may forever alter a person's future.

"We desire to see Mr. Bethel's scholarship re-instated. If he is re-instated, it is our belief that his consequences should not be greater than those of Ms. Battle. If he is not re-instated, a public exoneration of his character on the part of Texas Tech University should be forthcoming, since Mr. Bethel's future opportunities for an education as well as an athletic career have been jeopardized."


Battle released a statement on July 4, apologizing for her actions and acknowledging that she "initiated the first contact." She has been suspended for one month by Texas Tech.

Nigel Bethel II has been reinstated by Texas Tech, less than three weeks after he was dismissed for punching Red Raiders women's basketball player Amber Battle.

The freshman cornerback from Miami will return to Lubbock, Texas, and rejoin the program but will be suspended for Texas Tech's first three games, the school announced Wednesday.

"This is an unfortunate situation with a unique set of circumstances and there are no winners," Texas Tech athletic director Kirby Hocutt said in a statement. "Every decision related to this case has been the right one at that particular time based upon our principles, student-athlete code of conduct and team rules.

"As I continued to work with Coach (Kliff) Kingsbury and Coach (Candi) Whitaker, we looked at the totality of the situation and have arrived at this decision. Two talented young people made a mistake, have shown remorse and learned some very valuable life lessons."

Bethel's suspension for 25 percent of the season is equal to the one-month suspension Battle previously received for all TTU games in the month of November.TTU's Bethel reinstated, suspended 3 games

"I am thankful for the opportunity to come back to Texas Tech," Bethel said in a statement released by the school. "I take full responsibility for my actions and I would like to let everyone know that this won't happen again. It's not who I am and I am sorry for the embarrassment this has caused.

"I want to thank Amber Battle for accepting my apology and for coming forward to say that I deserved a second chance. I would like to thank everyone at Texas Tech, including the coaches, for believing in me and giving me a second chance to show my ability and to receive an education from Texas Tech."

Bethel will not face assault charges for the incident after a grand jury cleared him on Tuesday. The grand jury also submitted a letter to Hocutt expressing a "desire to see Mr. Bethel's scholarship reinstated."

During an on-campus pickup basketball game on June 28, Bethel hit Battle, the Red Raiders' leading scorer last season, in the face in retaliation after she hit him following a foul.

Bethel was dismissed from the program the next day. Texas Tech released security video of the fight on Wednesday.

"I'm relieved that Nigel is receiving a second chance because I believe in second chances," Battle said in a statement. "We were both at fault in this situation and I believe our punishment should be equal. This is a good opportunity for us to learn from our mistakes and I think we both have. Hopefully now we can move forward and focus on helping our teams compete at the highest level."

Lubbock attorney Tray Payne, who represented Bethel, said he was satisfied by the school's decision.

"I believe in second chances," Payne said. "I don't necessarily believe in third and fourth chances, but I believe in second chances and Texas Tech does too."

Bethel was the Red Raiders' highest-rated recruit in their 2014 class and had joined the program in June.

"I'm really excited," Bethel told ESPN.com about his reinstatement. "I feel like Texas Tech is my only home."

Not sure where I stand on this. In this day and age is it okay to hit a woman even if she strikes first?

NFL sends awful message with Rice suspension

Ray Rice was suspended two games by the NFL for knocking out his fiancee. The incident was caught on tape. Rice entered a pre-trial diversion program.

Repeat offenders of the drug policy are subject to four-game suspensions. A violent tackle, done in the course of a game, will draw a single game suspension. Selling your autograph while still in college? That will get you five games off.

But in the NFL’s court, hitting a woman so hard that she becomes unconscious and has to be dragged out of an elevator only gets you a two-game suspension.

NFL, if you’re going to care about women, keeping the ones closest to your players safe is your first stop.

Don’t tell me you care about women’s health come October. Don’t pinkwash the whole league and pay lip service to how much you care about women. Don’t trot out breast cancer survivors as symbols of the NFL’s close relationship with women and then give a man who threatened a woman’s health — ON TAPE — a two-game suspension.

The NFL had an opportunity to send a clear and direct message about the consequences of domestic abuse. They could have looked past the PR campaign Rice and the Ravens are now putting on. They could have seen the press conference Rice and his now-wife participated in as the sham it was.

According to the Bureau of Justice Statistics, one in four women will be abused in their lifetime. This year, 1.3 million women will be assaulted by their partner. The NFL could have said to the women who silently suffer through domestic violence that the biggest, richest league in the country has their backs.

Instead, they’re telling players that smoking a joint — which is legal in two states — is much worse than knocking out a woman.
