Former Xavier University basketball star Dez Wells might just get his day in court.
Expelled in August 2012 after a campus disciplinary board found him responsible for sexual assault, Wells sued in August 2013, charging that XU and President Michael Graham ignored evidence from Hamilton County Prosecutor Joe Deters that the charges were unfounded.
Tuesday, U.S. District Court Judge Arthur Spiegel threw out Wells' request to vacate his expulsion because the statute of limitations has expired as well as claims against Graham.
But Spiegel refused Xavier's motion to dismiss claims for libel, breach of contract, infliction of emotional distress and violation of Title IX anti-discrimination laws.

A former soccer player is suing Xavier University, claiming he was injured in a hazing incident and then driven from the team and the university.
Neil Henley’s complaint, filed Feb. 18 in Hamilton County Common Pleas Court, charges that he attended a soccer party in February 2013, was forced to drink excessively for nine hours “against his will,” then fell and sustained a concussion.
Once he returned to the team, Henley suffered another concussion. He claims coach Andy Fleming forced him to sign a document outlining “performance issues” and eventually revoked his scholarship in June 2013.
He said Fleming knew about the party, held at a house on Hopkins Street known as the “Soccer House.”
