Sure. They only asked for them about a dozen times. Without McCabe and the lovebirds running the investigation the servers would have been subpoenaed. At that point they probably would have been destroyed if they haven’t already.

Well it is a politfact they didn't get the original server

It is a poltifact they did get a copy

What is not a politifact is that the copy was what was requested and originally desired by law enforcement.
Knowing how political Comey is I highly doubt he would lead a crusade against the DNC during an election cycle to get evidence they did not want to turn over. I could see the copy being a compromise.

1, 2, and 4 would not constitute obstruction of justice.

3 might, but is not proved by any evidence so far. And it would not be an effective way to obstruct IMO, because once pardoned their 5th amendment protections are no longer needed. Once those go away, they could be compelled to testify and obligated under penalties perjury to do so truthfully.

It's not just "tinfoil wearing right wingnuts" that want the physical servers. Or at least it shouldn't be. For the life of me, I can't comprehend how a competent investigation into activities that involve hacking of servers can proceed without a physical forensic examination of the servers themselves. And when what happened was an analysis by a IT firm that is essentially a captive associate of the DNC, who then prepared a "copy" that Comey deemed suitable for the FBI, I foresee a whole lot of potential evidentiary issues.

Off what I know right now, which I admit freely may very well not be the whole story, if I were a judge sitting on this case, I would not allow any testimony about the servers to get in without having a physical forensic examination performed on the servers themselves. And with the passage of almost two years' time, the possibility of tampering would be so great that I'm not sure any forensic examination could be completed in a way that provided complete assurance. I find it truly mind-boggling that an investigation into Russian tampering with our election could go forward at all, much less to this point, without the FBI taking and maintaining custody of the servers and performing, or having performed, a thorough forensic examination of the servers themselves, and not some electronic "copy."

Just like the Trump dossier, the fact that the copy of the server the feds received was not intentionally modified is also unproven
