It's is per se a violation to drive with a BAC of .08% or higher. One doesn't actually have to be "drunk" or impaired to be in violation.
So that's the rule.
Which, should mean it isn't impermissible to drive with a .03%. However, one can't drive with an open beer, even if that person is at 0.0%.
That's idiotic.
If I want to drive from my friends house 5 miles away and pop a cold one along the way (and am at 0.0%) then why should that be illegal? I'm not anywhere close to 0.8% nor will I be after about the four pulls I'll take in the 10 minute drive.
BUT it is illegal--so you know what? I don't do it. And I won't do it unless the law changes.
