It's more accurate to say his findings will be based upon some facts and his version or interpretation of them. They won't be objective. The facts presented will support the conclusion he's trying to sell. This is true in all litigation even prosecutions or investigations.

I'm an attorney and a prosecutor. Basically every side interprets the facts and tries to push their version of them. It's how our adversarial system works. You highlight favorable facts and downplay unfavorable ones. I see it all the time in law enforcement reports too. It's why it is so important for everyone to have defense counsel if you're a suspect of a crime. You need someone to highlight the facts favorable to you and poke holes in the government's theory.

Hell he just indicted a company that did not exist at that time. How many people walk out of prison on a reversal after being convicted on findings based on fact? He will shape the facts around his view of them
