My first ever remark to you was me actually agreeing with a point you were making but it appeared you were so full of piss and vinegar and argumentative, that it zoomed right over your head. JMUDunk saw it, and commented on it.

Tanq, you remind me of a long-dead brother of mine who used to argue about anything and everything. Heck, he'd argue even if he actually agreed with the original assertion being made. And yes, like you, he was an attorney, though until recently, because of the shame it brought my family, I told everyone he was a piano player in a whorehouse.

Anyway, keep posting. Like I said, you've made some insightful posts and I agree with many of your political positions. Just don't try to bullshyte seasoned bullshytters. I tried that earlier on in my internet career, on poltical forums in particular, and got my ass handed to me more times than I care to remember.

By the way your pic of Adler is hilarious. And interestingly somewhat memorable.

Before I went the transactional route full-bore, in my first firm all the 1st years first-chaired cases for 'friends of the firm' (big firm, lots of 'friends'). Mine was pitted against Adler's firm. That picture truly does capture his personality, unfortunately.

My guffaws in my post on that were mainly and truly about the coincidence of that pic showing up in your post. Scared the fing crap out of me, tbh.

And, btw, I really do know more than a smattering (but definitely not large) number of people at Arnold and Porter. Mainly Silicon Valley, but a couple DC. At this point I respect you having your position that you think they sat on their asses; my personal guess is that they did not. And let us just leave that at that.

I beat a multinational law firm without an attorney over a trademark issue about 6 years ago. Thats a fact. I had actually forgotten about it until just now. They were pretty much dumbasses. I shite you not.

A lot of supposed 'trademark' attorneys are just that. Congrats shere. Seriously. Quick question though: State court or Federal?

Or did it even enter the courts and was just a 'cease and desist' that you negotiated through? Lot of TM folks send C&Ds out by the bucketload, many with no chance of success. They just hope to cow the poor dudes that get them.

If that was the case in your issue -- congrats for shoving the overreach back in their face. That is fun position to be in, because typically you can fk up their PTO registration when they arent able to shove the threat through on the overreach.

Federal. Honestly I cant remember all the details but it pretty much what you described. If i recall correctly i argued with them through correspondence and copied a judge of some sort. I beat them using the tactics from a case i found online that was similar. It really wasnt a big deal.

So the TM holder filed on you in court without a preliminary nastygram? If they did that that was not smart at all. Also when you file Federal, you are stuck there until the judge (and the other party) lets you out.

Congrats for beating them back.

I'd ask for the TM, but I realize what that means and I wont. I had done some TM stuff way back when. I know that a lot of TM holders stretch the crap out of the mark when they try to enforce, either mark-wise (their mark sounds just a tad like yours) or 'subject matter wise' (marks are similar, but yours is for jet engines and theirs is for baby food). It is really fun to blow those stretches out of the water.

You summed it up pretty well. It was a trademark with a Latin root word. One of the rare times in my life that four semesters of Latin actually paid off in the practical world. It would have been expensive but not fatal if I had lost. It was a big firm with a global client that came after me. I felt bullied and pissed off at the time. I was frankly surprised when I beat them. One of many fires though, easy to forget.

Anyway we eff with each other pretty hard sometimes here, nothing personal.
