Can fans + players’ families file class action lawsuit against ESPN?
To reimburse flight + hotel costs? If espn cannot prove it was impossible to reschedule, any lawyers here might want to stick their hand in this cookie jar.

https://techcrunch.com/2018/03/30/nianti...over-1-5m/

Quote:Back in July of last year, Niantic organized an outdoor festival focusing on its augmented reality game, Pokémon GO. In theory, players would come from all around for a day of wandering Chicago’s Grant Park, meeting other players and catching new/rare Pokémon.

It… did not go as planned. Widespread cellular connectivity and logistical issues brought the game (and thus the event itself) to a halt before the doors even opened. People booed. People threw things at the stage. People sued.

While Niantic quickly announced that they’d be refunding all ticket costs (and giving players $100 of in-game currency), that still left many of the estimated 20,000 attendees out the cost of hotels, transportation, etc.

Niantic is settling a class action suit surrounding the festival, TechCrunch has learned, paying out $1,575,000 dollars to reimburse various costs attendees might have picked up along the way. Things like airfare, hotel costs, up to two days of parking fees, car rental, mileage and tolls.

According to documents filed in a Chicago court, an official website for the settlement should be up by May 25th, 2018, with an email sent to let attendees know. The documents also note a few potential catches: those claiming part of the settlement will need to have checked in to GO Fest through the game (presumably to prevent those who sold their tickets for a markup from getting more money out of it), and anyone claiming more than $107 in expenses will need to have receipts.

If there’s money left after all claims, lawyer fees, etc, the documents note that the remaining balance will be split evenly and donated to the Illinois Bar foundation and the nonprofit organization Chicago Run. “In no event will money revert back to Niantic” it reads.

Why not turn some ambulance chasers into disrupted event chasers? It could be the next best thing to asbestosis for lawyers.

The only thing that may be reimbursed is the price of the tickets as long as they were bought through the schools. Otherwise, they are screwed.

Not a similar situation at all. A similar situation would be if ESPN had to cancel the game because they forgot to reserve the stadium or forgot to hire officials. Weather is always a risk you take with an outdoor sporting event, and it's almost certainly in the fine print of the ticket.

I believe this would be more akin to a family saving to go to Disney world and then having the park close due to s hurricane. Sucks for the family

You would have to prove that ESPN did something wrong. Generally, you are not responsible for acts of God (i.e. weather and natural disasters).

You would have to prove that ESPN had an obligation to reschedule.

I believe anything else you did like amusement parks, pre-game events, sight seeing, etc. would weaken any arguments.

I'd be surprised if ESPN didn't have a separate, non-profit corporation to manage the bowl. This would in effect isolate them from potential issues, including conflict of interest.

Michael Avenatti filed a suit against the Pro Football Hall of Fame as the cancellation of the 2016 HoF game but the Court ruled against his proposal as the HoF's refund offer was fair. The NFL was originally part of the suut, but was dropped from it.

They Should refund the tickets but I'm having a hard time understanding why travel/lodging would be reimbursed. They were still able to travel to Dallas

If this were the Hawaii Bowl or Bahamas Bowl and it was somehow cancelled they wouldn’t be comping anyone’s flight and hotels because some of some $10 tickets to a game

Servpro Bowl says "all ticket sales are final" and is refusing to refund tickets (what a crock of shite!), but both BC and Boise say anyone who bought tickets through them will be refunded.

I wish ESPN could be sued for totally making a wreck of college football, but it won’t happen.

Good pivot by the Bowl, the initial "all sales are final" stance was probably not going over well in the twitterverse.
