In reality the intent of the person holding it.
Perceptually for the ignorant, it looks dangerous.
A Samurai with a sword is holding an assault weapon.
Legally it is the magazine capacity and it's semi-automatic nature that makes it legal like any other semi-automatic hunting weapon.
The bump stock should never have been legal because it subverts Class 3 license requirements.
Magazine capacity only indicates possible intent. If the rifle is being used to hunt the law is 5 rounds anyway in many states. If it is being used for personal defense in a volatile situation (think a widespread riot with armed looters) 30 is reasonable, but clearly intended for a more military style usage. I have no problem with 30 round magazines as long as they are for home defense and aren't out publicly.
An actual assault rifle contains a different tension spring, a selector switch for full auto, 3 round bursts, and semi-automatic, and has a different sear. Many times it will have bayonet lugs and might have a factory flash suppressor on it. That weapon requires a Class 3 license.
But note: There is nothing illegal about bayonets or flash suppressors. Silencers on the other hand fall under the same restrictions as fully automatic weapons. What's really sad is that many anti-gun people don't know the difference between flash suppressors and silencers.
So in my opinion there is no difference between a military looking semi automatic rifle and any other semi automatic hunting rifle. In fact I prefer open sites on a carbine style semiautomatic rifle when hunting wild hogs. They are fast and lethal and you can't track them in a scope effectively.
True in most states, not TN. We recently passed a law allowing them. TN law makes no distinction between a silencer and a suppressor but any informed individual knows that a silencer only "silences" sub-sonic rounds.
"The Tennessee Hearing Protection Act of 2017 is going (went) into effect on July 1, 2017".

I'm really not keen on politicians being able to take away constitutional rights by passing a criminal law.
I'm all for fully giving felons back all of their rights IF their crime was a non-violent one and IF they stay out of trouble completely for a period of time (7 years? 5 years?...it's debatable).
I have a friend that is a felon. He committed a non-violent offense and now cant travel outside the country, vote, or own a gun, and he can hardly find a job. The thing is he is an extremely sharp guy and would be an asset to any company he worked for. He's taken and passed every math class any college offers.
He refuses to turn back to the life he was living before, but not being able to find gainful employment beyond the $7-10 an hour range makes it so hard not to.
I see why others get looped into recidivism and why the cycle perpetuates.
There's a process in place to regain his rights. He'll need a lawyer to petition the courts and at least two character references willing to get up in open court and testify to his worthiness. W. Ray and I were talking about this very thing just yesterday, he's been involved in several of these petitions. On a side note, I wish you were as exposed to him as am I, he is a font of information and a source of constant amusement. Anther of his friends and myself are talking about writing a book of Rayisms entitled "Every Day Is An Adventure: How Dare You?!"
You should come to town next weekend and attend the class we've got set up for next Sunday. I'll get you a cut rate.
Edit: He is always talking about starting a periodical satire work with the first cartoon being a photo of Steve Cohen standing next to himself, one in a wedding tux, the other in a bridal gown, with the caption "To dispel any vicious rumors, Cohen marry's himself".

True, nothing stops the crack of a supersonic round. And silencers can't silence the mechanism of the gun itself. If it's a semi-automatic pistol you still hear the slide cycling in another round.
